SCHOOL BUS ACCIDENTS

In Miami, the Perazzo Law Firm understands that placing your children in the care of a school bus driver is never easy, as the school bus driver is basically a stranger; at least at first. Though school buses are relatively safe, accidents involving school buses are quite common and injuries don't only occur while the school bus is in motion, but also when the bus is stopped. Getting on and off a school bus is equally as dangerous as being on a school bus in motion. In fact, and according to the National Center for Statistics and Analysis, the part of the ride which presents the most danger is getting on and off the bus, which can be the direct consequence of hasty and negligent motorists. When a child is struck by a moving vehicle when getting on or off the school bus, the consequences can end in serious bodily injury or even wrongful death in a school bus accident. In Miami, the Perazzo Law Firm knows all too well the effects negligent drivers, especially those using their cell-phones, can inflict on children boarding or getting off a school bus. For motorists trapped within the hustle and bustle of everyday life, every second counts and that can lead to motorists negligently zooming past school buses with absolute disregard for the warning lights that signal otherwise. Though school bus accidents that involve children boarding or getting off have negligent drivers at fault in 9 out of 10 school bus accident situations, the Perazzo Law Firm knows that drivers may also be held accountable. Figures published by the National Association of State Directors of Pupil Transportation Services reveal that close to 11,000 Florida motorists pass stopped buses every day within the 67 school districts that took part in the 2018 survey.

SCHOOL BUS ACCIDENTS AND THE LAW

In Florida, passing a school bus that is stopped and has its red safety lights flashing, is illegal by motorists. Sadly, the American School Bus Council states that this simple rule is regularly ignored by more than ten million motorists yearly. According to the Florida Highway Safety and Motor Vehicles, drivers may pass a stopped school bus on the opposite side of a roadway when there exists five feet or more of unpaved space that divide traffic lanes; with Miami-Dade and Broward leading the way. The Florida Highway Safety and Motor Vehicles imposes penalties on motorists that pass stopped school buses such as; moving violation with fines starting at $165 and four points on the negligent motorist’s license when passing on the opposite side of a stopped school bus. The fine can start at $265 if a motorist passes a school bus on the side that has children boarding or getting off a school bus. Regardless, traffic accidents still rank at the top when it comes to children injured in school bus related incidents. The Perazzo Law Firm recommends that in the event that motorist negligence leads to personal injury or wrongful death to a child getting on or off a school bus, the negligent motorist may be subject to:
  • 120 hours of community service
  • Take part in a Florida Highway Safety and Motor Vehicles driver improvement program
  • Six points added to the his/her driver’s license
  • A one-year suspension of their driving privileges.
  • A fine in the sum of $1500

PERAZZO LAW SHARES SCHOOL BUS SAFETY ADVICE

Prevention is the best course of action whenever the chances of accident exist. It’s no secret that we do not live in a perfect world, and when we place our trust in others, things can go wrong. That is why, there are measures that can be taken to help prevent a child from being injured in a school bus related accident. In Miami, the Perazzo Law Firm urges parents or the legal guardians of children taking school buses to take certain precautions to reduce the risk of suffering bodily injury. Of all motor vehicles on Florida avenues, highways, and streets, school buses are among the most strictly regulate and are inspected monthly. Sadly, school bus accidents in Florida have been on the rise since 2014. That is why it is important to take certain measures to prevent school bus accidents.
Perazzo Law recommends parents and legal guardians to do the following help prevent injury from a school bus accident:
  • Know your child’s bus route.
  • Instruct your child to refrain from walking behind the school bus.
  • When walking in front of the school bus, instruct your child to maintain ample space between the front of the school and him or her.
  • Instruct your child to wait for the bus to stop completely before stepping into the street or road before attempting to board the school bus.
  • Instruct your child to make sure the seat belt is properly fastened and stay in their seat until it is time to get off the school bus upon reaching its destination or in case of an emergency which requires unfastening the seat belt and standing.
  • Inquire about school bus route, the driver/s, and overall condition of the school bus; which includes proper seats, working seat belts, emergency exits free of obstructions, emergency lights that function properly, and GPS services.

SCHOOL BUSES AND SCHOOL BUS DRIVERS

The Perazzo Law Firm understands that school bus accidents may be the result of negligent motorists or poorly maintained units. However, school bus drivers can sometimes be held accountable for accidents which lead to personal injury involving children. In Miami, the Perazzo Law Firm knows that negligent school bus drivers do exist, regardless of the strict regulations and measures aimed at making sure school bus drivers act and drive accordingly. Sadly, human error exists and school bus drivers are human. Negligent cell phone use seems to be practically unavoidable, even by school bus drivers. School buses are big, bulky and clumsy vehicles, hence, even at slow speeds, they may be hard to control in the event that a sudden, drastic maneuver is required by a distracted school bus driver. The rise in population has led to an increase in school bus traffic; hence, more school bus drivers are needed. Training responsible school bus drivers is fundamental, and Florida is investing in training individuals looking to transport school children safely. Training includes a two-day training on how to approach a stop properly and how to respond to emergency situations once a child has boarded the school bus.

School Bus Driver Requirements:
  • Class B Commercial Driver's License
  • Valid and approved physical examination
  • Valid and approved criminal background check (no prior record of any criminal activity)
  • Trained in federal and state regulations
  • Exercise proper driving skills
  • Subject to random drug screening
  • Subject to random mental and physical check-ups
School bus drivers are expected to act responsibly when transporting children and refrain from acting negligently while children are getting on or off the bus. They are required to obey traffic laws and respect speed limits. Any violation of these guidelines that lead to personal injury to school children or other passengers such as teachers, counselors, or guardians, may find the driver legally liable for injuries or losses incurred.
